The opinion by federal district judge Vaughn Walker striking down Prop. 8 claimed that it was irrational for voters to affirm traditional marriage. The brief filed by PJI demonstrates that Western civilization has always encouraged traditional marriage as foundational to society. While homosexuality was widely practiced in ancient Greece and Rome, the brief shows, leading thinkers of the time strongly supported traditional marriage.
PJI Chief Counsel Kevin Snider, who authored the brief, commented, ”By calling support for traditional marriage norms irrational, Judge Walker has not only insulted the majority of Californians and Americans, but also some of the greatest minds in history, including Socrates, Plato, Aristotle and Cicero. Calling these luminaries irrational is itself irrational.”
